eCebuana Terms and Conditions


  1. TERMS OF USE

    1. 1.1. These terms and conditions (“T&C” or “Terms”) govern the terms under which you may access and use the products of Cebuana Lhuillier Bank, which include the eCebuana App, eCebuana Visa Virtual Card and the available services within the application together the “Service” or “Services”). By accessing, registering or using the Services in eCebuana App, you agree to be bound by the terms of this T&C.

    2. 1.2. Under these T&C, the terms “eCebuana”, “we”, “us”, and “our” refer to Cebuana Lhuillier Rural Bank together with its employees, directors, affiliates, successors and assigns. Cebuana Lhuillier Rural Bank is duly registered with the Bangko Sentral ng Pilipinas (BSP) and licensed as an Electronic Banking and Electronic Money Issuer (EMI). As a licensed EMI issuer, Cebuana Lhuillier Rural Bank manages all e-money instruments and is duly responsible for the EMI holders/users.

    3. 1.3. The terms “you” and “your” refer to Users of the Service, as eCebuana registered users, Microsavings and Cebuana Savings Account Holders, Visa Virtual Cardholders, Senders, Recipients, and other applicable users of the Service.

    4. 1.4. These T&C shall be effective, valid and binding from the time that you agree to it upon registration or the time you use any of the Services, and will be in full force and effect up to the time that it is terminated by you or us, save for some provisions which shall remain effective after termination, as stated in this T&C, under any law, rule or regulation.

    5. 1.5. Cebuana Lhuillier Rural Bank reserves the right to modify these T&C at any time without any advance notice. Any changes to these T&C will be effective immediately upon posting in eCebuana app, with an updated effective date. By accessing or using eCebuana Service after any changes have been made, you signify your agreement on a prospective basis to the modified T&C and all the changes. User must access this page periodically to ensure familiarity with its most current version.

    6. 1.6. You must be at least eighteen (18) years of age to register for an eCebuana account. By registering, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to agree with these T&C.

    7. 1.7. eCebuana Services are for individual use only. If this will be used for the benefit of a business entity, you represent, warrant, and covenant that you are duly authorized to do business and your officers, employees, representative, and agents accessing or using eCebuana app are duly authorized to access and use the eCebuana Services and to legally bind you and your business entity to these T&C and all transactions conducted under your Username and password.

    8. 1.8. When you accept these T&C, you are setting up your eCebuana account that is associated with your mobile number. You will be asked to provide information such as your complete name, present and/or permanent address, date of birth, nationality, source of funds, employment data, photo of yourself, and signature in accordance with the KYC requirements of the BSP. We may also verify your registration information through a third-party verification partner/service provider, as we may deem necessary. In some cases, we may also ask you to provide additional details or information that can aid in verifying your identity.

    9. 1.9. You agree to provide all necessary information and render all reasonable assistance and cooperation that we may require in order to complete the verification process. The information you provide will be used to determine if you are eligible to use the eCebuana App or the eCebuana Services. We reserve the right to suspend, deactivate, or limit your access to your account in the event that we are unable to obtain or verify your information. We shall process your personal data in accordance with the requirements of the Data Privacy Act of 2012, its implementing rules and regulations, and the issuances of the National Privacy Commission (NPC).

  2. DEFINITIONS

  3. In these Terms and Conditions of Use, the following capitalized terms shall have the following meanings, except where the context otherwise requires:

    1. 2.1. “ACCOUNT/ECEBUANA ACCOUNT” – an account created by a User in the eCebuana App as part of Registration.

    2. 2.2. “AMLA” – refers to the Anti-Money Laundering Act, as implemented by the Anti-Money Laundering Council (AMLC) of the Philippines.

    3. 2.3. “BASIC WALLET” – refers to eCebuana app’s initial level of account creation, allowing users to use limited wallet functionalities such as cash in, buy load and pay bills.

    4. 2.4. “BENEFICIARY” – receiver of funds from a send money transaction.

    5. 2.5. “BILLER” – refers to any accredited company authorized to accept bills payment using the Service.

    6. 2.6. “BIOMETRICS” – refers to the User’s measurement and analysis of unique physical or behavioral characteristics (such as the face, fingerprint, or voice patterns), especially as a means of verifying personal identity.

    7. 2.7. “CEBUANA LHUILLIER RURAL BANK INC.” (“CLB” or the “BANK”) – is a rural bank duly registered with the Bangko Sentral ng Pilipinas (BSP) and licensed as an Electronic Banking and Electronic Money Issuer.

    8. 2.8. “CEBUANA SAVINGS ACCOUNT” – This refers to an interest bearing savings account which is anchored on BSP’s Regular Deposit account. It is exclusively offered by CLB to a Micro Savings Account holder.

    9. 2.9. “ECEBUANA APP” or the “ECEBUANA MOBILE APP” – is a mobile application of Cebuana Lhuillier Rural Bank, running on mobile devices where customer can avail of the service or make use of the products.

    10. 2.10. “ECEBUANA SYSTEM” – is the system accessed by the Bank.

    11. 2.11. “KNOW-YOUR-CUSTOMER (KYC)” – refers to the process of identifying and verifying the true and full identity of customers. The term is also used to refer to the anti-money laundering regulations which govern these activities.

    12. 2.12. “MICRO SAVINGS” – refers to an interest bearing deposit which is linked to the 24k Cebuana Card or other proprietary card that may be issued by CLB which may be accessed thru its channels such as but not limited to Cash Agents. Should the Client exceed the maximum balance of PHP50,000.00, the Bank shall convert the basic deposit account to a regular deposit account thus the terms and conditions for regular deposit accounts shall apply.

    13. 2.13. “ONLINE PAYMENTS” – refer to the payment by an Account Holder to an online Merchant over the internet.

    14. 2.14. “OTP” – refers to the One Time PIN, which is a form of password valid for a transaction with a device or system.

    15. 2.15. “PIN” – refers to the 5 digit security Personal Identification Number of, and nominated by eCebuana customer during the registration process.

    16. 2.16. “QR CODE” – a quick response code issued by eCebuana to a Merchant, wherein if used, would refer to the payment details of the Merchant.

    17. 2.17. “REGISTER/REGISTRATION” – to create an eCebuana User account on eCebuana Mobile App.

    18. 2.18. “REGULAR WALLET” – refers to the upgraded basic wallet that offers clients higher transaction limits and access to more advanced wallet features.

    19. 2.19. “SENDER” – refers to a person who sends money using eCebuana’s Send Money, Bank transfers or other money sending service.

    20. 2.20. “TRANSACTION HISTORY” – allows user to view all the financial transactions successfully initiated inside the application.

    21. 2.21. “USER” or “ACCOUNT HOLDER” – refers to a Cebuana Lhuillier Rural Bank client who is using the eCebuana App.

    22. 2.22. “QR MICRO MERCHANT” – refers to Cebuana Lhuillier Rural Bank’s accredited establishment who can accept QR payment from other banks and other CLB accounts for purchase of goods and services.

  4. SERVICES

  5. All the services provided by Cebuana Lhuillier Rural Bank Inc. to its Users via eCebuana App, and Service refers to any of the following services enumerated in this section.

    1. 3.1. “BILLS PAYMENT” enables users to pay bills to accredited billers thru eCebuana app and to use the available funds in the account holder’s eWallet or Microsavings / Cebuana Savings account.

    2. 3.2. “BALANCE INQUIRY” enables Users to view their account balance in the eCebuana Mobile App.

    3. 3.3. “BUY INSURANCE” is a service that enables Users to purchase insurance products.

    4. 3.4. “CASH IN” refers to adding/ funding money into an eCebuana wallet, via Cebuana Lhuillier Rural Bank’s accredited channels or partners.

    5. 3.5. “CASH OUT” refers to the process of withdrawing or transferring money into another eCebuana wallet, savings account or any accredited channels or partners.

    6. 3.6. “BUY LOAD” enables Users to purchase telco products such as regular, special or promo loads for accredited Telco partners using balance from User’s eWallet, Micro Savings or Cebuana Savings account.

    7. 3.7. “QR PAY” refers to cashless payment to merchants using QR code for purchase of goods and services.

    8. 3.8. “SEND MONEY” allows Users to send money to a beneficiary thru bank transfer, eWallet transfer or via domestic and international remittance.

    9. 3.9. “RECEIVE MONEY” refers to receiving money from the sender thru bank transfer, eWallet transfer or via domestic and international remittance.

    10. 3.10. “VISA VIRTUAL CARD” is a virtual card co-branded with Visa linked to User’s fully verified eCebuana wallet account which will allow them to do financial services available in eCebuana app as well as online purchases through visa accredited.

  6. FEES AND OTHER CHARGES

    1. 4.1. eCebuana app users agrees to pay for any fees , rates and other charges and applicable taxes, related to the Service and its use, as may be imposed by Cebuana Lhuillier Rural Bank.

    2. 4.2. Fees and other charges, as may be applicable, shall be inclusive of all applicable Philippine taxes and shall be debited from eCebuana wallet/VISA Wallet, Microsavings / Cebuana Savings.

    3. 4.3. Should these fees and other charges result to insufficient balance in the account of the user, the transaction will not proceed and will require Cash in thru any accredited partners.

    4. 4.4. The amount of fees and charges may be revised from time to time as Cebuana Lhuillier Rural Bank may deem necessary, effective immediately upon notice to eCebuana users.

    5. 4.5. Standard carrier fees may be charged by a telecommunications service provider against user’s prepaid phone balance or postpaid phone account when using the eCebuana app and its services.

    6. 4.6. Any refund amounts will be credited back to the same Account used to fund a refunded Transaction and in the same currency.

  7. DORMAN

    1. 5.1. eCebuana account shall be considered dormant when there’s no financial transaction movement for the period of two (2) years and shall be subject to dormancy fee.

    2. 5.2. In case of dormant accounts with zero (0) balance, the Bank may automatically close these accounts when there was no financial transaction movement despite continuous reminder from the Bank.

    3. 5.3. Dormancy fee shall be debited automatically from the User’s eCebuana Wallet in accordance with applicable laws, rules and regulations.

    4. 5.4. eCebuana accounts with balances that remain inactive for 2 years can be reactivated if account holder undergoes and passes a KYC process to be conducted by Cebuana Lhuillier Bank.

  8. FRAUD/SCAMS / SUSPICIOUS TRANSACTIONS / MISREPRSENTATION AND/OR ANY FORM OF DECEIT

    1. 6.1. The Client shall be solely responsible for the safety and security of his personal and bank account information from fraud, scam, deceit, or any forms of misrepresentation, such as but not limited to:

      • Skimming and jackpotting
      • Recruitment fraud
      • Card Cloning
      • Unauthorized online lenders
      • Identity theft
      • Unauthorized withdrawal
      • Text Scam
      • Customs / Package Scam
      • Phishing
      • Spoofed websites
      • Falsified Bank Documents / Falsified IDs
      • Fake Documents
      • Donation / Charity / Product Scam
      • Investment Scam
      • Advance fee fraud
      • Unauthorized Funds Transfer via EOL / Mobile App
      • Love Scam
      • Unauthorized Online Payment
      • Internet Fraud
      • False Identity / Misrepresentation

    2. 6.2. Cebuana Lhuillier Bank reserves the right to hold and/or debit suspicious accounts used for fraud, deceit, misrepresentation, and other illegal activities especially if, upon due notice, the Depositor refuses in any manner to cooperate, reply, and/or intentionally avoid official communications made by CLRB through its duly authorized representatives, within the specified timeline. Likewise, the same shall apply if the communications made by CLRB to the depositor does not reach the latter by reason of non-updated contact details on records of CLRB.

    3. 6.3. Upon receipt of reports and/or suspicion of fraud or any suspicious transaction/s, Cebuana Lhuillier Bank reserves the right without notice to suspend or terminate the card and/or the account in accessing the bank’s facilities and channels such as the ATM, POS, eCeb, and other banking services.

    4. 6.4. The User agrees and acknowledges to hold Cebuana Lhuillier Bank free and harmless from liabilities for any losses, claims, or legal actions as a result of any or all of the following:

      1. 6.4.1 Any damages arising from or in relation to the use of CLRB’s deposit accounts as a medium to commit fraudulent activities as herein contemplated.

      2. 6.4.2 Any service honored by any other bank, financial institution, or Merchant, however payment transaction is not authorized for any reason whatsoever.

      3. 6.4.3 Any delay, interruption or termination of the Service transaction whether caused by administrative and human error, technical, mechanical, system failure, electrical or electronic fault or difficulty or any other reason or circumstance beyond CLB’s control.

      4. 6.4.4 Any possible data and system breach or exposure when using the Virtual Card, Account and/or Service, including but not limited to Card/ Account details, and personal information.

      5. 6.4.5 Any damages/claims arising from any unauthorized use of the Virtual Card or eCebuana App.

  9. APPLICABILITY OF TERMS AND CONDITIONS

  10. The use of any Services and or the eCebuana App is subject to these Terms and Conditions of Use. eCebuana App can be downloaded in iOS and Android. You can register as long as your mobile number is active and your mobile device has at least version 8.1 for Android and iOS 11 or above. User must register to utilize the eCebuana App. eCebuana App will be made available to Users with no fee, unless otherwise determined by CLB.

    One must be an Account holder of CLB in order to enroll to eCebuana App and make use of its Services. The Mobile App is completely customer self-service where User shall enter/provide preferred User Name and Password. The bank recommends the use of a strong but easy to remember log in details.

    eCebuana App processes financial and non-financial transactions such as: Send Money, Load Top-up, Bills Payment, Change Password, View Personal Information, Account Balance Inquiry and Branch Locator.

    A PIN is required to access eCebuana account. The Bank shall not allow access if incorrect Pin is entered three (3) times and will temporarily block the account.

    One Time Pin (OTP) will be sent to the registered mobile number of the User/Account Holder for authorization of financial and non financial transactions. The Bank shall not allow processing of transaction with incorrect OTP.

    We reserve the right to change, modify, substitute, suspend or remove without notice any information or Services on the Mobile Application from time to time. Your access to the Mobile App and or the Services may also be occasionally restricted to allow for repairs, maintenance or introduction of new facilities and or services. We will attempt to restore such access as soon as we reasonably can. We reserve the right to block access and or edit or remove any material which in our reasonable opinion may give rise to a breach of these Terms and Conditions of Use.

    Every successful financial transaction and other significant actions done via eCebuana App will be sent to User’s enrolled mobile number for safety and records purposes. Details of the transaction will be recorded in the Bank’s eCebuana system and the same will be regarded as conclusive proof of the validity and authenticity of the transactions made.

    Any services, enhancements and features of eCebuana App that needs User’s consent shall be confirmed via SMS or call to make the User informed of the specific service, enhancement or feature the account holder has subscribed to and the exact duration of the subscription. User will also be notified of the expired subscription of the service, feature and enhancement.

    User hereby agrees to receive transaction notifications, announcements and be regularly updated by the Bank and its subsidiaries and affiliates (hereinafter, “Cebuana Lhuillier Group”) of their products and services and thus understand fully that account holder foregoing information will accordingly be shared.

    User understands that the bank at times may not be able to carry out instructions received through eCebuana App due to offline situations caused by system problems or such other circumstances as determined by the bank.

    User has full responsibility over the security of his/her Mobile Device/s, SIM card and confidentiality of his/her User ID and password/s and all transactions, whether valid or fraudulent, authorized or unauthorized, made through said Mobile Device/s/SIM card and via eCebuana App, if such fraudulent or unauthorized transaction was caused by or is a result of the User’s fault or negligence. The Bank encourages the User to change password regularly, especially when account details have been exposed.

    It is User’s sole responsibility to reset the password through eCebuana App if its confidentially has been reasonably suspected to have been compromised to avoid any unauthorized use of the User’s accounts. The bank shall not be liable for any unauthorized use / misuse of the Mobile App due to theft or loss of the Mobile Device/SIM.

    The Bank has the right to rectify any incorrect crediting to the User’s account without the bank suffering any liability. The User hereby consents thereto without need of further act and deed or with or without notice to the User. The Bank has the right to debit from the account the erroneous credit.

  11. RULES ABOUT USE OF THE SERVICE AND THE MOBILE APPLICATION

  12. We will use reasonable endeavors to correct any errors or omissions as soon as practicable after being notified of them. However, we do not guarantee that the Services or the Mobile Application will be free of faults. Accordingly we will not accept liability for any such faults, errors or omissions. In the event of any such error, fault or omission, you should report it by contacting us through Cebuana CARES Hotlines via the following:

    We do not warrant that your use of the Services or the Mobile Application will be uninterrupted and or that any information or messages transmitted via the Services or the Mobile Application will be transmitted accurately, reliably, in a timely manner or at all. Notwithstanding that, the Bank will exert earnest-efforts to provide uninterrupted access to the Services and the Mobile Application. Access to the Services and the Mobile Application may be suspended, restricted or terminated at any time.

    eCebuana App, the Services, the information entered therein and use of all related facilities are provided on an “as is, as available” basis without any warranties whether express or implied.

    To the fullest extent permitted by applicable law, we disclaim all representations and warranties relating to the eCebuana App and its contents, including any inaccuracies or omissions in the Mobile Application, accuracy, availability, noninfringement or implied warranties in the course of the User’s dealing or usage of trade.

    We shall not be liable for any acts or omissions of any third parties howsoever caused, and for any direct, indirect, incidental, special, consequential or punitive damages, howsoever caused, resulting from or in connection with the mobile application and the services offered in the mobile application, your access to, use of or inability to use the mobile application or the services offered in the mobile application, reliance on or downloading from the mobile application and or services, or any delays, inaccuracies in the information or in its transmission including but not limited to damages for loss of business or profits, use, data or other intangible, even if we have been advised of the possibility of such damages.

    We shall not be liable in contract or otherwise howsoever and whatever the cause thereof, for any indirect, consequential, collateral, special or incidental loss or damage suffered or incurred by you in connection with the Mobile Application and these Terms and Conditions of Use. For the purposes of these Terms and Conditions of Use, indirect or consequential loss or damage includes, without limitation, loss of revenue, profits, anticipated savings or business, loss of data or goodwill, loss of use or value of any equipment including software, claims of third parties, and all associated and incidental costs and expenses.

    The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer that cannot be excluded or limited are affected.

    Notwithstanding our efforts to ensure that our system is secure, you acknowledge that all electronic data transfers are potentially susceptible to interception by others. We cannot, and do not, warrant that data transfers pursuant to the Mobile Application will not be monitored or read by others.

  13. INDEMNITY

  14. You agree to indemnify and keep us indemnified against any claim, action, suit or proceeding brought or threatened to be brought against us which is caused by or arising out of (a) your use of the Services, (b) any other party’s use of the Services using your user ID, verification PIN and or any identifier number allocated by Cebuana Lhuillier Rural Bank, and or (c) your breach of any of these Terms and Conditions of Use, and to pay us damages, costs and interest in connection with such claim, action, suit or proceeding.

  15. AMENDMENTS

  16. We may periodically make changes to the contents of the eCebuana App, including the descriptions and prices of products and services advertised, at any time. eCebuana users shall be notified in thirty (30) calendar days before any amendments/changes to these terms and conditions may take effect. We assume no liability or responsibility for any errors or omissions in its contents.

    We reserve the right to amend these Terms and Conditions of Use from time to time without notice. The revised Terms and Conditions of Use will be posted in the eCebuana App and shall take effect from the date of such posting. You are advised to review these Terms and Conditions periodically as they are binding upon you.
